Kashmir: A Product of Two-Nation Theory

Josef Korbel from Czechoslovakia was a UN nominee for plebiscite, who wrote a book titled “Danger in Kashmir”. He wrote about the demilitarization issue which India used as a lame excuse and on this pretext, India always deterred and denied plebiscite. Similar was the opinion of the General McNaughton, Canadian administrator for plebiscite appointed by the United Nations Security Council to resolve the Kashmir issue amicably. Sir Owen Dixon, a judge of the Australian High Court, did his best as the UN representative, to hold a free and fair plebiscite in Kashmir. Pakistan agreed to demilitarize but India refused to withdraw the large bulk of its military force from Kashmir. 


It is noteworthy that the actions of India are a severe threat to the peace and safety of the region. Both countries are nuclear powers and Kashmir is a nuclear flashpoint. Therefore, the current circumstances attract Chapter VII of the UN Charter. According to Chapter VII, the aggressor country will have to face serious consequences such as severance of diplomatic relations, economic embargoes and military action if need be. India is consistently violating the UN resolutions and its actions are alarming and endangering peace and stability of the world, therefore, it is time that Chapter VII should be invoked against India.



In his letter to Maharaja Hari Singh on October 27, 1947 the Governor-General of India, Lord Mountbatten wrote: “In consistence with their policy that in case of any State where the issue of accession has been the subject of dispute, the question of accession should be decided in accordance with the wishes of the people of the State”. 
In the light of these clear instructions by Lord Mountbatten, the Kashmiris have the full right to exercise their right to self-determination. It is the height of travesty that the present Indian government of Prime Minister Narendra Modi has revoked the Articles 370 and 35A of the Indian Constitution and state machinery is used to terrorize the incarcerated Kashmiris. The Indian premier has emerged in the form of Hitler and has crossed all the limits of humanity and civility. Death is dancing like a pestilence on the streets of Indian Illegally Occupied Jammu & Kashmir. The Indian hardliners imprecate the non-Hindus and are displaying the zenith of improbability and impropriety. Prime Minister Modi has violated the Indian Constitution and UN resolutions on the one hand and recently, he announced in a public meeting that he would cancel the Indus Waters Treaty and make dams on the rivers and stop the water of the rivers flowing towards Pakistan. It will be another breach of an international pact. Any such move will be an act of aggression against Pakistan and will certainly destabilize the region. 


Research Service of European Parliament has issued a research document captioned, “Indian Administrated Kashmir – Present Situation”. In this document, the situation of Indian Illegally Occupied Jammu & Kashmir after August 5, 2019 has been described. After the annulment of Article 370 from the Indian Constitution and continuous lockdown, the situation in Kashmir is highly miserable. Kashmir is besieged and people are randomly killed. 


India shamelessly claims that after the Simla Agreement between Pakistan and India, the resolutions of the United Nations on Kashmir are invalidated. It is absolutely untrue and misleading. In the Simla Agreement both countries agreed to bilaterally resolve the Kashmir issue, which does not preclude the UN resolutions because UN is a superior forum and its resolutions are binding on member states. In the Agreement, it is not mentioned that Pakistan will withdraw the case from UN Security Council. It should be noted that according to the Chapter VI of the Charter of UN, Kashmir issue is a bilateral issue, which has to be decided as per aspirations of the Kashmiris by a free and fair plebiscite held under the auspices of the UN. The aforesaid Chapter further stipulates that if the issue cannot be resolved bilaterally then the concerned countries can mutually decide to appoint an arbitrator. India has always refused the offer of some countries who expressed their wish to play a role in amicably resolving the Kashmir issue. But it is on the record that India neither intended to resolve bilaterally nor accepted the mediation of a third party. Now, the government of Modi has touched the boundaries of bestiality. It has even declined to implement the UN resolutions.


Kashmir issue is basically a product of Two-Nation Theory and has been made an apple of discord by the ferocity and furor of Indian Machiavellian diplomacy and duplicity. Pakistan was created on the basis of the Two-Nation Theory, that is, the Pakistan Ideology.

A book written by eminent Kashmiri historian Prof. Khan Zaman Mirza titled “Who is Aggressor in Kashmir?” speaks volumes about the incessant and consistent atrocities perpetrated on the docile and defenseless Kashmiris by the Indian army.

On the other side, the Indian ambassador to the United States Harsh Vardhan Shringla wrote an article titled, ‘India is Building a More Prosperous Kashmir’ in The New York Times and maintained that India will make Kashmir a prosperous state. It is the height of foolery of an Indian diplomat. The Kashmiris are fighting for freedom, not for Indian so-called prosperity. For the past 72 years, Kashmir has been under the occupation of India but they could not make Kashmir a prosperous state because the people of Kashmir want freedom from Indian occupation. According to a recent report published in Western media, nearly 200 young girls have been abducted by the Indian Army and their fate is unknown. 


Quaid-i-Azam was very sensitive about Kashmir. He visited Kashmir seven times. In his last visit, he asked Sheikh Abdullah to desert and dissolve national conference and rejoin Muslim Conference. Quaid-i-Azam also told him that the Hindus and Muslims cannot live together and we have to protect the interest of the Muslims.

Sir Syed Ahmed Khan, after realizing the scornful attitude of Indian Hindus, stated: “Hindus and Muslims cannot live together as a single nation. Hindus and Muslims are two major nations that hold outstanding differences between their way of life, religion, customs, culture, and historical traditions”. In 1930, Dr. Allama Iqbal at the 21st Session of All-India Muslim League held at Allahabad categorically announced: “India is a continent of human groups where they belong to different races, speak different languages and profess different religions. Their behavior is not at all determined by a common consciousness… The Muslim demand for the creation of a Muslim India within India, therefore, perfectly justified”. Quaid-i-Azam was very sensitive about Kashmir. He visited Kashmir seven times. In his last visit, he asked Sheikh Abdullah to desert and dissolve national conference and rejoin Muslim Conference. Quaid-i-Azam also told him that the Hindus and Muslims could not live together and the interests of the Muslims had to be protected, but for his petty personal and political interest, Sheikh Abdullah did not accept the advice of Quaid-i-Azam. It is incumbent to mention here that according to the physician of Quaid-i-Azam who attended him during his last days in Ziarat, Balochistan, the Quaid use to talk about Kashmir even in the last days of his life and in the most critical health condition, which shows his love and commitment to the Kashmir cause. 


Pakistan is incomplete without Jammu & Kashmir. It is the life-line of Pakistan. The Kashmiris are resolved to join Pakistan as the majority of them are Muslims. India is trying to change the demography of Jammu & Kashmir.

The first Prime Minister of India Jawaharlal Nehru made international pledges to grant the right of self-determination to the Kashmiris but betrayed the Kashmiris afterwards. He once said that the solution of the Kashmir issue lies in time. By this he meant that the new generation of Kashmir will forget the Kashmir issue. Today, his soul might be seeing that the Kashmiris are not fighting for economic prosperity but for their faith and freedom. Kashmir is under siege and the people of Indian Illegally Occupied Jammu & Kashmir beseech the lovers of democracy and justice all over the world to raise voice against Indian aggression on the unarmed civilians.
